"Dinner's On Franki" Holiday Program Terms and Conditions

Effective Date: 1 December 2025.


Overview


Franki is excited to announce the 2025 "Dinner's On Franki" Holiday Program, which includes:


  1. A Surprise Holiday Rebate Program, where select users will receive 100% cashback on Eligible Purchases made through the Franki app during the campaign period.


Campaign Period


The Program begins on December 1, 2025, at 12:00 AM PT and ends on December 26, 2025, at 11:59 PM PT (the "Campaign Period").



Eligibility


The Program is open to legal residents of the United States, aged 18 or older, who:


  1. Have downloaded the Franki app.
  2. Created a valid account.
  3. Connected a valid payment card to their account.

Employees, officers, directors, and agents of Franki, its affiliates, and their immediate family members or household members are not eligible to participate.



Here’s the updated and simplified definition of Eligible Purchases without the merchant participation requirement and streamlined for inclusion in the terms and conditions:


Eligible Purchases


For the purposes of the "Dinner’s On Franki" Holiday Program, Eligible Purchases are defined as follows:


  1. The purchase must be made using a payment card connected to the user’s Franki account.
  2. Before making the purchase, the user must tap and activate a cashback offer within the Franki app.
  3. The transaction must result in the successful issuance of a cashback reward to the user’s account.
  4. Exclusions:
    • Purchases for which the user did not activate a cashback offer in the Franki app before payment are not eligible.
    • Refunds, chargebacks, or canceled transactions are not Eligible Purchases.


Surprise Holiday Rebate Program


How It Works


  • Users who make Eligible Purchases through the Franki app during the Campaign Period will earn standard cashback (5–15%) as per Franki’s regular terms.
  • A select number of users will be chosen randomly from Eligible Purchases to receive 100% cashback on their Eligible Purchase (capped at $500 per transaction).

Selection Process


Eligible users who make Eligible Purchases during the Campaign Period may be randomly selected to receive 100% cashback on their purchase (up to $500).


  • Random Selection: Every week during the campaign period, Franki will randomly choose a group of eligible users who made Eligible Purchases during the previous 7 day period.
  • Selection Criteria: To be eligible for selection, users must have made an eligible purchase, as outlined in the Program’s terms, within the seven (7) day period prior to selection.
  • Notification: Users who are selected for cashback will be notified via email and in-app notification within ten (10) days after their eligible purchase.

Limitations


  • Users may only receive one 100% cashback reward during the Campaign Period.
  • Cashback rewards are credited to the user’s linked payment method based on Eligible Purchases and cannot be transferred to another user or account.


General Conditions


Publicity Release


  • By participating, users agree to allow Franki to use their name, likeness, and submitted content (e.g., social media posts) for promotional purposes without additional compensation, unless prohibited by law.

Taxes


  • All federal, state, and local taxes associated with prizes are the sole responsibility of the winners. Franki may request a W-9 and/or issue a 1099-MISC tax form for any prize valued at $600 or more, as required by law.

Limitation of Liability


  • Franki is not responsible for technical issues, lost, late, incomplete, or misdirected entries, or any errors in the administration of the Program or the announcement of prizes. Franki is not liable for any damages arising from participation in the Program, acceptance or use of any prize, or technical failures beyond its control.

Data Privacy


  • By participating, users consent to the collection and use of their personal information by Franki for the purposes of administering the Program, as detailed in Franki's Privacy Policy. Franki will not share or sell personal information except as necessary to fulfill the prize delivery obligations.

Modification and Termination


  • Franki reserves the right to modify or terminate the Program at its discretion if fraud, technical issues, or other unforeseen circumstances compromise its integrity. Franki may disqualify any individual found tampering with the entry process, engaging in fraudulent activity, or violating these Terms and Conditions.

Governing Law


  • The Program and its terms are governed by the laws of the State of California.
